Terms & Conditions

1. It is the responsibility of all prospective buyers to examine and satisfy themselves as to the condition of each lot prior to the auction,
2. No statutory “cooling off ” period shall apply in respect of the sale of any lot. A buyer shall accordingly not be entitled to rescind any sale or request a refund of any payment pertaining thereto after his bid has been fi nally accepted by the auctioneer, save in the circumstances expressly provided for in these general conditions of business.
3. Any estimated selling range provided by Daville baillie Gallery to the seller is a mere statement of opinion and should not be relied upon as a true reflection of the hammer price which a lot may achieve at a sale. Daville Baillie Gallery reserves the right to revise the estimated selling range at any time.
4. The parties consent to the jurisdiction of the Magistrates Court in terms of section 45 of act 32 of 1944 as amended for all purposes in terms of this agreement the seller shall be entitles at his sole discretion to institute action in any other court having competent jurisdiction.
